Question 3

How much is the break fee when a tenant ends a fixed-term residential tenancy agreement early in NSW?

Accepted Answer

Answer:For fixed-term residential tenancy agreements of 3 years or less, the statutory break fee is a set amount based on how much of the fixed term has expired at the time the tenant vacates:4 weeks' rent if less than 25% of the fixed term has expired.3 weeks' rent if 25% or more but less than 50% of the fixed term has expired.2 weeks' rent if 50% or more but less than 75% of the fixed term has expired.1 week's rent if 75% or more of the fixed term has expired. For fixed-term agreements of more than 3 years, the agreement may specify a fixed break fee amount, or the tenant may be liable to compensate the landlord for actual losses (such as advertising costs and unmitigated lost rent until a new tenant is found).Exceptions: A break fee does not apply if the tenant ends the lease early for a legally permitted reason under the Residential Tenancies Act 2010—such as escaping domestic violence, accepting an offer of social housing or an aged care placement, an undisclosed intention to sell by the landlord, an uninhabitable premises, or a landlord's breach of agreement

Question 4

How Is Monthly Rent Calculated?

Accepted Answer

If rent is $700 per week, the monthly rent is $3,041.67, not $2,800.Why is it NOT $2,800 per month?Multiplying $700 by 4 weeks assumes that a calendar month has only 28 days. However:February is the only month with 28 days (in a non-leap year). All other months have 30 or 31 days (roughly 4.33 weeks per month).A calendar year has 52 weeks (365 days), not 48 weeks ($12 ext{ months} imes 4 ext{ weeks} = 48 ext{ weeks}$).If a tenant were to pay $2,800 per month, they would only be paying for 48 weeks of rent per year, leaving 4 full weeks unpaid. How to Calculate Calendar Monthly Rent?Under the Residential Tenancies Act 2010, rent accrues from day to day. In Australian real estate practice, monthly rent is calculated using the standard formula:Daily Rate Calculation (365 Days)This method calculates the exact daily rent and multiplies it by the average number of days in a month:Daily Rent: $700 \div 7 days = \$100 rent per day.Annual Rent: $100 imes 365 days = $36,500 rent per yearMonthly Rent: $36,500 \div 12 months = $3,041.67 per calendar month.
